  23. Plain English Evaluation License Agreement and Limited Warranty
  24.  
  25. 1. SUMMARY.  You may install this SOFTWARE on as many computers as
  26. your license allows, and no more:
  27.  
  28.      You may access the software through a network, provided that you
  29.      have obtained individual licenses covering all computers that
  30.      will run the software from the network. For instance, if six
  31.      different workstations will access the software on the network,
  32.      you will need a six-user license, whether they use the software
  33.      at different times or concurrently.
  34.  
  35.      * Home License/Personal Edition
  36.      May be used by one person in a home environment. CANNOT be used
  37.      in government, business or any organization.
  38.      
  39.      * Single User License/Desktop Edition/Single User Pack
  40.      May either be used by a single person who uses the software
  41.      himself on one or more non-server class computers, or installed
  42.      on a single non-server class computer and used by multiple
  43.      people, but not both.
  44.      
  45.      * 10 Days Only License (TextPipe Pro only)
  46.      May be used for 10 unique calendar days (consecutive or non-
  47.      consecutive), as determined by our license server.
  48.      
  49.      * Single CPU License (per processor)
  50.      One license is required for each CPU in a computer. For example,
  51.      if a computer has four CPUs, four CPU Licenses are required.
  52.      
  53.      * 5 User Pack
  54.      May be installed on UP TO FIVE (5) non-server class computers
  55.      ONLY
  56.      
  57.      * 10 User Pack
  58.      May be installed on UP TO TEN (10) non-server class computers
  59.      ONLY
  60.      
  61.      * Server License
  62.      May be installed on ONE (1) server class computer ONLY
  63.      
  64.      * Site License/Educational Site License
  65.      May be installed on UP TO 500 computers of server class or non-
  66.      server class at one site ONLY
  67.      
  68.      * Enterprise License/Company Edition/University Edition
  69.      May be installed on UP TO 2000 computers of server class or non-
  70.      server class  directly owned by a Company or University ONLY
  71.      (but not on client's computers)
  72.  
  73. This is a legal agreement between you and CRYSTAL.  By using the
  74. SOFTWARE you are agreeing to be bound by the terms of this Agreement.
  75. Do not use the SOFTWARE if you do not agree to the terms of this
  76. Agreement.

  78. 2. DEFINITIONS.  In this agreement:
  79.  
  80.      *    "SOFTWARE" means the computer program you have purchased
  81.           or obtained for evaluation, including the program,
  82.           associated documentation and other materials;
  83.           
  84.      *    "Evaluation Copy" means a copy of the SOFTWARE distributed
  85.           by us or by our authorised agents for evaluation purposes
  86.           and which is described as an "Evaluation Edition" or a
  87.           "Shareware Edition" by the SOFTWARE's "About" screen;
  88.           
  89.      *    "Commercial Copy" means a copy of the SOFTWARE purchased
  90.           from us or from a dealer, and is NOT described an an
  91.           Evaluation Copy by the SOFTWARE's "About" screen.  The
  92.           actual description may include "Desktop Edition", "Single
  93.           User Edition", "Personal Edition", "Server Edition", "Site
  94.           Edition" or "Company Edition" or other variations
  95.           depending on the version purchased;
  96.           
  97.      *    "you" means the end user of the SOFTWARE.  This can be
  98.           either an individual or an entity;
  99.           
  100.      *    "server class" means a computer designated as a file
  101.           server, database server, application server or other kind
  102.           of server;
  103.           "desktop class" or "non-server class" means a computer
  104.           where only one person uses it at a time;
  105.           
  106.      *    "CRYSTAL" means Crystal Software, an Australian
  107.           corporation (address shown above).
  108.           
  109.  
  110. 3. GRANT OF LICENSE.  CRYSTAL grants you the right to INSTALL this
  111. software on as many computers as you have purchased a license for.
  112. You may NOT install it on computers that you do not have a license
  113. for.
  114.  
  115. The SOFTWARE is "installed" on the computer when it is loaded into
  116. permanent memory (e.g. hard disk, CD-ROM, or other storage device) of
  117. the computer.
  118.  
  119. 4. COPYRIGHT.  The SOFTWARE is owned by CRYSTAL and is protected by
  120. copyright laws and international treaty provisions and all other
  121. applicable national laws.  Therefore, you must treat the SOFTWARE
  122. like any other copyrighted material (e.g. a book or musical
  123. recording) except that you may make one copy of the SOFTWARE solely
  124. for backup or archival purposes.  You may not copy the user
  125. documentation provided with the SOFTWARE.
  126.  
  127. 5. OTHER RESTRICTIONS.  You may not rent, lease, sell, or attempt to
  128. rent, lease or sell the SOFTWARE. You may transfer the SOFTWARE and
  129. accompanying written materials on a permanent basis provided you
  130. retain no copies and the recipient agrees to the terms of this
  131. Agreement.
  132.  
  133. You must not copy, translate, adapt, modify, alter, decompile,
  134. disassemble, or otherwise reverse engineer or create any derivative
  135. work of the SOFTWARE, merge the SOFTWARE or any part thereof with any
  136. other software or change any SOFTWARE in whole or in part, nor allow
  137. any other party to do so.  You must not alter or remove any copyright
  138. or other intellectual property notifications applied to the SOFTWARE.
  139.  
  140. You acknowledge that the SOFTWARE and the copyright, and other
  141. intellectual property rights of whatever nature in the SOFTWARE are
  142. not your property and contain valuable proprietary information and
  143. trade secrets and that this license confers no title or ownership in
  144. the SOFTWARE and no rights in any associated source code, and is not
  145. a sale of any rights in SOFTWARE.
  146.  
  147. 6. EVALUATION PERIOD.  You may use an Evaluation Copy of the SOFTWARE
  148. for up to 30 days in order to determine whether it meets your needs.
  149. While you are evaluating the SOFTWARE, you may use it on as many
  150. computers as are required to perform your evaluation.  Your
  151. evaluation period begins when you first install the SOFTWARE on one
  152. or more computers for evaluation purposes.  Once the evaluation
  153. period is over you MUST PURCHASE THE SOFTWARE or REMOVE IT FROM ALL
  154. COMPUTERS. If you use the software for commercial purposes DURING
  155. your evaluation you MUST PURCHASE THE SOFTWARE.
  156.  
  157. 7. MAKING AND DISTRIBUTING EVALUATION COPIES OF THE SOFTWARE.  You
  158. may make copies of your Evaluation Copy of the SOFTWARE to give to
  159. others, as long as you include all of the files that you originally
  160. received with your Evaluation Copy.  When you give an Evaluation Copy
  161. of the SOFTWARE to another person, you agree to inform them that
  162. their copy is to be used for a time-limited evaluation period, and
  163. that they must purchase a Commercial Copy if they continue to use the
  164. SOFTWARE once the evaluation period has ended.  You agree not to sell
  165. Evaluation Copies of the SOFTWARE or distribute them to others for
  166. any kind of compensation or fee unless the fee solely covers your
  167. costs in providing it to the end user.

  169. 8. OPERATION OF THE SOFTWARE.  The SOFTWARE offers powerful
  170. capabilities.  If you do not follow our instructions, or if you use
  171. the SOFTWARE improperly, you can destroy files or cause other damage
  172. to your software and data.  You assume full responsibility for the
  173. selection and use of the SOFTWARE to achieve your intended results.
  174.  
  175. 9. LIMITED WARRANTY.  The following limited warranty applies to
  176. Commercial Copies of the SOFTWARE.  It is included here so you
  177. understand what your warranty will be when you purchase a Commercial
  178. Copy. This warranty does NOT apply to Evaluation Copies of the
  179. SOFTWARE.
  180.  
  181. Bugs and SOFTWARE Errors. We don't promise that the SOFTWARE will be
  182. free of bugs or errors. If you report an error or bug to us, we will
  183. use our best efforts to correct it.
  184.  
  185. 10. DISCLAIMERS AND LIMITATIONS.  And now the legal language we
  186. couldn't avoid:

  188. DISCLAIMER FOR EVALUATION COPIES: YOU ARE NOT PAYING FOR THE TRIAL
  189. USE LICENSE FOR YOUR EVALUATION COPY OF THE SOFTWARE.  ACCORDINGLY
  190. THE EVALUATION COPY IS PROVIDED "AS-IS" AND WITHOUT WARRANTY OF ANY
  191. KIND.
  192.  
  193. DISCLAIMER FOR COMMERCIAL COPIES: Except for the limited warranty
  194. stated above, we disclaim any and all other warranties, express or
  195. implied, oral or written, including any implied warranties of
  196. merchantability or fitness for a particular purpose.  The limited
  197. warranty above gives you specific legal rights, but you may have
  198. other rights, depending on where you purchased the SOFTWARE.
  199.  
  200. LIMITATION OF LIABILITY.  IN NO EVENT SHALL WE BE LIABLE FOR ANY
  201. INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER ARISING OUT
  202. OF USE OF THE SOFTWARE OR YOUR RELATIONSHIP WITH US.  SOME COUNTRIES
  203. OR STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF LIABILITY FOR
  204. INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE THE ABOVE LIMITATION
  205. MAY NOT APPLY TO YOU.

  207. 11. This agreement is to be interpreted under the laws of the state
  208. of Victoria, Australia.
